(“we,” “us,” “our” or “Titan”), our MyTitan Application or the ControlMax Application (together with MyTitan Application, the “Apps”) (collectively, the “Services”) and how we use and share the information we collect.

Information for Users Accessing the Services from Outside the United States
The Services are currently hosted on servers located in the United States, although we reserve the right to relocate the Services to other servers elsewhere in the world. Your information may be stored on servers located within the United States or in another country. In addition, we may transfer your information to our service providers and others located in the United States or another country for the purposes described in this Policy. Different countries have different privacy laws and requirements, and some provide less legal protection for your information than others. Please know, however, that no matter where your information is collected, used, transferred or stored, if it was collected through the Services, it will be governed by the terms of this Policy.
BY USING THE SERVICES, YOU ARE CONSENTING TO THE COLLECTION, USE, AND TRANSFER OF YOUR INFORMATION IN OR TO THE UNITED STATES OR TO ANY OTHER COUNTRY IN THE WORLD SUBJECT TO THE TERMS OF THIS POLICY.
Types of Information We Collect
Information You Volunteer . Titan collects the Personal Information you knowingly and voluntarily provide when you use the Services. “Personal Information” includes but is not limited to name, email address, company name, address, location, preferences, job title, employment information, purchase history and purchase information. We collect the Personal Information you provide when you download and use our Apps, login to our Site, contact us with questions, sign up for a newsletter, or review a product. Some of the information you post to the Services may constitute User-Generated Content. You may also have the capability to take photographs of your work and link third party accounts to the Services.
Information Others Volunteer. Users may invite you to the Services or initiate the signup process on your behalf. These users may provide us information about jobs you perform, relationships to other users and other work-related information.
Information Automatically Collected. When using sprayers equipped with IntelliSync, we may automatically collect information about the location of the sprayer (which may also identify your location).
Web Browser Information . We collect information that is sent to us automatically by your Web browser. This information typically includes your IP address, the identity of your Internet service provider, the name and version of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. Please check your browser if you want to learn what information your browser sends or how to change your settings.
More About IP Addresses. An “IP address” is a unique number that is automatically assigned to your computer when you connect to the Internet. It is used to identify your computer’s “location” in cyberspace so that the information you request can be delivered to you. If you use a dial-up connection or a connection that assigns dynamic IP addresses, your computer will be assigned a new IP address each time you connect to the Internet. However, if your computer is permanently connected to the Internet using a static IP address, the IP address assigned to your computer will generally be the same each time you use your computer.
We may link your IP address to account information that identifies you personally. We may also provide your IP address to our third-party service providers who can use it to identify your state and zip code. This gives us valuable demographic information about the individuals who use the Services. In addition, if we suspect inappropriate or criminal activity or a threat to the security of the Services, we may share our server logs—which contain users’ IP addresses—with the appropriate investigative authorities, who could use that information to trace and identify individuals.
Cookies and Similar Technologies. We use “cookies” and other web technologies to collect information and support certain features of the Services. For example, we may use these technologies to:
- collect information about the ways visitors use the Services—which pages they visit, which links they use, and how long they stay on each page
- support the features and functionality of the Services—for example, to save you the trouble of reentering information already in our database or to prompt the settings you established on previous visits
- personalize your experience when you use the Services
- to understand specific information related to the products you connect to the Services
Generally, if you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer. Please note, you must set your browser to reject cookies or alert you when a cookie is placed on all browsers and devices you use to visit the Services. Although you are not required to accept cookies when you visit the Services, you may be unable to use all of the Services’ functionality if your browser rejects our cookies.
Third-Party Cookies
In addition to the cookies Titan delivers to your computer through the Services, certain third parties may deliver cookies to your computer for a variety of reasons. For example, we use Google Analytics, a Web analytics tool that helps us understand how visitors engage with the Services. Likewise, marketing or advertising companies may deliver cookies through the Services or via e-mail that allow them to recognize you in future web sessions as someone who has expressed an interest in the Services or in our products or services.
Titan does not have access to, nor control over, the cookies of third-party service providers or advertisers. However, you have choices about the collection of information by third parties on the Services. For example, if you don’t want information about your visit to the Services sent to Google Analytics, you may download an Opt-out Browser Add-on by tools.google.com/dlpage/gaoptout. Please note that the Add-on does not prevent information from being sent to Titan. You may set your browser to reject cookies or to alert you when a cookie is placed on your computer. Both the Opt-out Browser Add-on and setting your browser to reject cookies are device specific and must be done on every device and browser you use to visit the Services. Please note that your browser settings may not allow you to control deliver of cookies via e-mail.
How We Use Information Collected Through The Services
Generally, we use the information we collect through the Services:
- to provide the information, products and services you request or that might be of interest to you
- to suggest content that might be relevant to you
- for our marketing purposes
- to locate sprayers
- for security, credit, or fraud prevention purposes
- to provide you with effective customer service
- to provide you with a personalized experience when you use our Sites

- to contact you with information and notices related to your use of our Sites

Information Disclosures
By using the Services, you are permitting us to disclose your information to others. We disclose your information to the following parties: other users in your group; marketing partners; business partners; our service providers; retailers and other parties that may provide services to you.
Your Choices
In General. We respect your right to make choices about the ways we collect, use, and disclose your Personal Information. Discussed above are choices you have about delivery of cookies to your computer through the Services. In addition, we generally will ask you to indicate your choices at the time we collect your Personal Information. For example, we provide you with an opportunity to “opt out” of receiving certain communications from us. In addition, we will include an “unsubscribe” link in each electronic newsletter or promotional e-mail we send you, so that you can inform us that you do not wish to receive such communications from us in the future.
Previously Expressed Preferences. If at any time you wish to be taken off our mailing lists, please contact us using the information provided below. Once we have the information we need, we will remove you from our mailing lists as you have requested. Please give us a reasonable amount of time to honor your request.
Push Notifications. Some of our Apps offer push notification options. Your mobile device requires you to opt-in to receive push notifications. You may enable or disable push notifications from our Apps in your mobile device’s settings.
How to Access, Update or Correct Your Personal Information
If you are a registered member of the Services, you may be able to access, update, or correct your Personal Information through your account settings. Otherwise, you may need our help. If you wish to access, update, or correct your Personal Information, please contact us using the information provided below. We will respond to you within a reasonable time and, in any case, within the time limits established by applicable law. We may ask you for additional information to verify your identity. In most cases, we will provide access and correct or delete any inaccurate information you discover. In some cases, however, we may limit or deny your request if the law permits or requires us to do so or if we are unable to verify your identify.
How to Delete Your Personal Information from our Apps
If you choose to discontinue use of our Apps, you may delete your account by opening the App Settings page, selecting “Delete Account” and confirming your choice to delete the account. Deleting your account does not delete any Personal Information you shared with us through the Apps. If you would like to delete your Personal Information provided through the Apps, please contact us using the information provided below.
Steps We Take to Safeguard your Personal Information
We maintain reasonable administrative, physical, and technological measures to protect the confidentiality and security of Personal Information you submit on or through the Services. Unfortunately, no website, app, server or database is completely secure or “hacker proof.” We therefore cannot guarantee that your Personal Information will not be disclosed, misused, or lost by accident or by the unauthorized acts of others.
How We Share Your Information With Others.
Third–Party Vendors. Titan shares information collected through the Services with third-party vendors who act for or on behalf of Titan. For example, we use third-party vendors to design and operate the Services, to conduct surveys, and to help us with our promotional efforts. These third-party vendors may need information about you to perform their functions.
Other Users of the Site. Your information may be shared with other users of the Services, depending on your classification. If you are invited to the Services by someone else, they may be able to see the content you post on the Services, status updates and location.
Business Negotiations. We may contemplate, for strategic or other reasons, selling, buying, merging, or otherwise reorganizing one or more of our businesses. In negotiating with a third party about entering into such an arrangement, we may need to disclose your information. In such cases, we will take reasonable measures to protect the information we disclose, for example, by requiring a prospective purchaser to sign a non-disclosure agreement limiting the use and protecting the confidentiality of the information.

Children Under the Age of Eighteen
We are proud of the Services, and we strive to ensure that it does not offend people of any age. However, the Services are not intended for children or minors under the age of eighteen years without the permission of a parent or guardian. This Policy describes Titan’s current policies and practices with regard to the information we collect through the Services.
We are continually improving and adding to the features and functionality of the Services and the services we offer through the Services. Definitions
The term “Content” refers to all of the software and code comprising or used to operate the Services, and all of the text, photographs, images, illustrations, graphics, sound recordings, video and audio-video clips, and other materials available on the Services, including User-Generated Content.
The term “New Ideas” refers to the Content you post on or through the Services that is specifically about how we can improve the Services and the products and services we make available through the Services.

CALIFORNIA STATE PRIVACY NOTICE
This California Privacy Notice (“Notice”) applies only to information collected about California consumers. This Notice describes Titan Tool, Inc. (“we,” “us,” “our” or “Titan”) practices regarding the collection, use, and disclosure of Personal Information and provides instructions for submitting data subject rights requests.
Definitions
- “ Personal Information ” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information includes “Sensitive Personal Information,” as defined below, except where otherwise noted.
- “ Sensitive Personal Information ” means Personal Information that reveals a consumer’s social security, driver’s license, state identification card, or passport number; account log-in, financial account number, debit card number, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; racial or ethnic origin, religious beliefs, or union membership; contents of email or text messages; and genetic data. Sensitive Personal Information also includes Processing of biometric information for the purpose of uniquely identifying a consumer and Personal Information collected and analyzed concerning a Consumer’s health, sex life, or sexual orientation.
- “ Third Party ” means a person who is not (1) Titan or a related business with whom the consumer intentionally interacts, (2) a service provider to Titan, or (3) a contractor for Titan.
- “ Vendor ” means a service provider, contractor, or processor as those terms are defined in the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).
To the extent other terms used in this Notice are defined terms under the CCPA, they shall have the meanings afforded to them in that statute, whether or not capitalized herein.

We, and our Vendors, collect and Process the Sensitive Personal Information described in this Notice only for:
- Performing the services or providing the goods reasonably expected by an average Consumer who requests those goods or services;
- Preventing, detecting, and investigating security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted Personal Information;
- Resisting malicious, deceptive, fraudulent, or illegal actions directed at us and prosecuting those responsible for those actions;
- Ensuring the physical safety of natural persons;
- Short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a Consumer’s current interaction with us, provided that we will not disclose the Consumer’s Personal Information to a Third Party and will not build a profile about the Consumer or otherwise alter the Consumer’s experience outside of their current interaction with us;
- Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on our behalf;
- Verifying or maintaining the quality or safety of a product, service, or device that is owned, manufactured, manufactured for, or controlled by us, and improving, upgrading, or enhancing the service or device that is owned, manufactured by, manufactured for, or controlled by us; and
- Collecting or Processing Sensitive Personal Information where such collection or Processing is not for the purpose of inferring characteristics about a Consumer.
We do not Sell or Share and have not Sold or Shared Personal Information about California consumers in the past twelve months. Relatedly, we do not have actual knowledge that we Sell or Share Personal Information of California consumers who are under 16 years of age. For purposes of the CCPA, a “Sale” is the disclosure of Personal Information to a Third Party for monetary or other valuable consideration, and a “Share” is the disclosure of Personal Information to a Third Party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
Retention of Personal Information
We retain your Personal Information for the period reasonably necessary to provide goods and services to you and for the period reasonably necessary to support our business operational purposes.
Categories of Personal Information We Disclose to Vendors and Third Parties
We disclose and have disclosed the following categories of Personal Information to Vendors and Third Parties for a business purpose in the past twelve months:

Sources from Which We Collect Personal Information
We collect Personal Information directly from consumers, as well as from social media platforms, and Vendors and Third Parties when they disclose Personal Information to us.
Categories of Entities to Whom We Disclose Personal Information
- Affiliates & Vendors. We disclose the categories of Personal Information listed in this Notice to our affiliates and Vendors for the purposes described in this Notice. Our Vendors provide us with services for our websites, as well as other products and services, such as web hosting, data analysis, payment processing, order fulfillment, customer service, infrastructure provision, technology services, email delivery services, credit card processing, legal services, and other similar services. We grant our Vendors access to Personal Information only to the extent needed for them to perform their functions, and we require them to protect the confidentiality and security of such information.
- Third Parties. We may also disclose the categories of Personal Information listed, above, for the purposes described in this Notice to the following categories of Third Parties:
- At Your Direction. We may disclose your Personal Information to any Third Party with your consent or at your direction.

- The business or commercial purpose for collecting, Selling, or Sharing Personal Information about you;
- The categories of Third Parties to whom we disclose such Personal Information; and
- The specific pieces of Personal Information we have collected about you.
- Right to Receive Information About Onward Disclosures : You may request that we disclose to you:
- The categories of Personal Information that we have collected about you;
- The categories of Personal Information that we have Sold or Shared about you and the categories of Third Parties to whom the Personal Information was Sold or Shared; and
- The categories of Personal Information we have disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose.
- Right to Opt-Out of the Sale and Sharing of Your Personal Information and Right to Limit the Use of Your Sensitive Personal Information : You have the right to opt-out of the Sale and Sharing of your Personal Information. You also have the right to limit the use of your Sensitive Personal Information to the purposes authorized by the CCPA. We do not Sell or Share and have not Sold or Shared Personal Information of California consumers in the past twelve months. Further, we do not use Sensitive Personal Information for purposes beyond those authorized by the CCPA, and we have not used Sensitive Personal Information of California consumers in the preceding twelve months for purposes beyond those authorized by the CCPA.
- Opt-Out Preference Signal . We do not Sell or Share Personal Information, or use or disclose Sensitive Personal Information for purposes other than those authorized by the CCPA and its implementing regulations. Accordingly, we do not process opt-out preference signals of California consumers. If we process opt-out preference signals of California consumers in the future, we will update this Notice to provide details about how we do so.
- Right to Non-Discrimination : You have the right not to be discriminated against for exercising your data subject rights. We will not discriminate against you for exercising your data subject rights.
California Residents Under Age 18. We do not knowingly collect or Process Personal Information of children under 18 years of age. If you are a resident of California under the age of 18 and a registered user of our website, you may ask us to remove content or data that you have posted to the website by writing to privacy@titantool.com. Please note that your request does not ensure complete or comprehensive removal of the content or data as, for example, some of your content or data may have been reposted by another user.
Disclosure About Direct Marketing for California Residents. California Civil Code § 1798.83 permits California residents to annually request certain information regarding our disclosure of Personal Information to other entities for their direct marketing purposes in the preceding calendar year. We do not distribute your Personal Information to other entities for their own direct marketing purposes.
Financial Incentives for California Consumers . We do not provide financial incentives to California consumers who allow us to collect, retain, Sell, or Share their Personal Information. We will describe such programs to you if and when we offer them to you.
Changes to this Notice . We reserve the right to amend this Notice in our discretion and at any time. When we make material changes to this Notice, we will notify you by posting an updated Notice on our website and listing the effective date of such updates.
